Earlier, a story covered a Montana homeowner who was sued by the city of Helena when he tried to repair the wood shingles on his home. Now, a Montana judge has ruled against the city and in favor of the homeowner. District Judge Kathy Seeley invalidated Helena’s 2008 fire ordinance restricting exposed wood building materials. The city ordinance allowed only fire-resistant shingles. The homeowner, a lawyer, argued that the city could enforce such things as height and building size but, under state law, could not enforce a building code unless the code was certified by the Department of Labor and Industry. Judge Seeley agreed with him. But the fight may not be over yet. City Attorney Jeff Hindoien says the city will probably appeal to the Montana Supreme Court, the Associated Press reports.
