OSHA has cited CLF Construction and Toll Brothers for exposing employees to fall hazards after a CLF employee suffered fatal injuries in a worksite fall in Media, Pa. The agency is proposing $170,560 for CLF Construction, a Philadelphia-based subcontractor, and $74,217 for Toll Brothers, the general contractor on the jobsite.

OSHA initiated an inspection after a CLF Construction employee fell 20 feet from a residential structure while working on framing and later died from his injuries. The agency cited CLF Construction for one serious violation and two willful violations for failing to provide and require the use of proper fall protection systems and not developing and implementing an accident prevention program to assist in identifying and correcting hazardous conditions. Toll Brothers was cited with one repeat violation for failing to ensure that its framing subcontractor provided employees with fall protection.

“Appropriate fall protection could have prevented this tragedy,” OSHA Philadelphia area director Theresa Downs said in a news release. “Every worker has the right to a safe workplace, and employers will be held accountable when they fail to meet this obligation.”

Both companies have 15 business days from receipt of the citations and proposed penalties to comply, request an informal conference with their OSHA area director, or contest the findings.
