The U.S. Department of Labor asked the U.S. Court of Appeals for the First Circuit to hold Massachusetts roofing company The Roof Kings and its owner, Graig Galligan, in civil contempt. Galligan and The Roof Kings allegedly have not fulfilled the terms of a court-ordered safety settlement from 2018, according to the agency.
OSHA cited The Roof Kings for fall and other hazards at four Massachusetts worksites between 2013 and 2016. The company and OSHA reached a settlement as part of a consent order in late 2017 that was approved by the Occupational Safety and Health Review Commission. The order required The Roof Kings to provide OSHA with abatement certification for 32 cited safety hazards and written notice of upcoming roofing jobs, as well as pay $72,000 in 60 monthly installments.
The Roof Kings allegedly made the first three monthly payments, but then failed to pay further penalties or fulfill the other obligations under the settlement. In 2018, the First Circuit granted the Department of Labor's petition for an order requiring the company to comply with the settlement agreement. The petition asks the court to order The Roof Kings to provide written certification they have abated the violations from the first settlement and pay overdue penalties of $206,090 plus interest. The petition requests coercive sanctions, including incarceration, should Galligan and The Roof Kings fail to pay and provide written certification.
