State court judges in two Louisiana parishes have issued rulings that limit builder liability for damages related to tainted Chinese drywall. Both judges found that drywall-related claims between homeowners and builders are regulated by the Louisiana New Home Warranty Act, and that drywall is not a structural component of a home, making it subject to a one-year warranty period. In both cases, plaintiff claims were dismissed because the suits against the contractors were filed more than one year after the homes were first occupied.
